Terms of service

Last updated 23 August 2026. These terms govern access to and use of SubathonOS.

1. Who these terms are with

SubathonOS is operated by Fin. You can contact us through privacy@subathonos.co.uk. These platform terms apply to the SubathonOS website, dashboards, Twitch integrations, public pages, overlays, support tools and related services.

If you have a signed order, quote, private agreement or other written commercial agreement with us, that agreement also applies. If there is a conflict, the signed agreement takes priority for the conflicting commercial term.

2. Eligibility and authority

You must provide accurate account information and use a Twitch account you are entitled to use. If you create or manage a subathon for another creator, you must have their permission to do so. The creator remains the owner of the Twitch connection and must approve creator ownership before Twitch tracking can become active.

If you are under 18, or otherwise do not have legal capacity to enter a contract yourself, you should use SubathonOS only with the involvement and permission of a parent, guardian or other person legally able to act for you. Any paid or private commercial agreement must be entered into by a person with authority and legal capacity to do so.

3. Your account and security

You are responsible for keeping access to your Twitch account and devices secure. SubathonOS uses Twitch OAuth and does not ask for your Twitch password. Do not share support grants, invitation links or other security credentials with people who should not have access.

Tell us promptly if you believe your SubathonOS access, Twitch connection or event has been compromised. We may revoke sessions, pause tracking or take other proportionate security action where necessary to protect users or the service.

4. What SubathonOS does

SubathonOS provides tools for subathon setup, timers, Twitch subscription and Bits tracking, manager/creator collaboration, milestones, overlays, public event pages, analytics controls, support and related event operations. Features may be improved, replaced or withdrawn where reasonably necessary.

Twitch events can be delayed, duplicated, changed or unavailable for reasons outside our control. SubathonOS uses validation, tracking windows and duplicate protection to reduce incorrect counting, but you remain responsible for supervising a live event and using the available manual correction and audit tools where appropriate.

5. Timer limits and event controls

Creators and authorised event staff can configure contribution rules, multipliers, schedules and timer limits. A configured maximum timer is an operational limit: contributions can still be recorded even where only part, or none, of the requested time can be added because the cap has been reached.

You are responsible for checking that your event rules are suitable before going live. Do not advertise event rules to viewers that materially differ from the rules you have configured without clearly correcting the public information.

6. Acceptable use

You must not use SubathonOS to break the law, infringe another person's rights, impersonate someone, interfere with the service, bypass access controls, probe or attack infrastructure, distribute malware, abuse invitations or support access, manipulate another creator's event without authority, or use the service for fraud or deceptive commercial activity.

You must not upload or publish content that you do not have the right to use. We may remove content, restrict a feature, suspend access or preserve relevant records where reasonably necessary to investigate abuse, protect users, comply with law or secure the service.

7. Your content and event data

You keep ownership of content you upload or create. You give us a limited licence to host, process, reproduce and display that content only as reasonably necessary to provide, secure and operate SubathonOS, including public event pages or designs you choose to publish.

If you publish a design to a shared public library, you confirm you have the necessary rights to share it and allow other SubathonOS users to install and adapt it within the service. You can unpublish your design, but copies already installed into another event may remain unless removal is legally required.

8. Twitch and other third-party services

SubathonOS depends on services operated by third parties, including Twitch and infrastructure providers. Their own terms and privacy rules apply to their services. We do not control changes, outages, rate limits, account enforcement or API behaviour imposed by those providers.

Disconnecting Twitch or revoking authorisation can stop tracking and may pause a running event. Some features cannot operate without the permissions they require.

9. Community access and optional support

The core SubathonOS operating service is available through Community access without a compulsory payment. We may offer optional supported-event extras. The Community page will explain the extras, event scope and claim process before support payments are enabled. A voluntary support payment does not buy ownership of the service or change the safety and privacy rules that apply to every event.

Payments are handled by the payment provider shown at the point of support. Any separate managed-service agreement will state its own price, duration, allowance and cancellation terms. If an advertised paid extra is not supplied or is faulty, contact support. Nothing in these terms removes statutory rights or mandatory consumer protections that apply to you.

10. Availability and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security incidents, internet failures, Twitch outages, hosting failures and other events can interrupt access. Where practical, we will take reasonable steps to restore service and reduce data loss.

We may update these terms when the service, law or commercial model materially changes. If a change significantly affects existing users, we will take reasonable steps to bring it to their attention before or when it takes effect.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

To the extent permitted by law, SubathonOS is not responsible for losses caused solely by events outside our reasonable control, third-party platform failures, or a user's unauthorised or incorrect configuration. Any additional liability limits applying to paid access should be stated in the relevant private agreement and remain subject to applicable law.

12. Suspension, termination and deletion

You can disconnect Twitch and may request account deletion through the privacy tools. We may suspend or terminate access where reasonably necessary for serious or repeated breach, security risk, non-payment under a private agreement, legal requirements or protection of other users.

Account deletion does not necessarily mean every record is erased immediately. We may retain or pseudonymise limited information where required for legal obligations, security, fraud prevention, disputes, audit integrity or the establishment, exercise or defence of legal claims. See the Privacy Notice for details.

13. Privacy and cookies

Our Privacy Notice explains how personal information is used and our Cookies & storage page explains browser storage and available choices. Data-rights requests can be made through Data rights requests, and data-protection complaints through Data protection complaints.

14. Governing law

Unless a mandatory law or a written agreement requires otherwise, these terms are governed by the law of England and Wales. If you are a consumer, you may also have the right to bring proceedings in the courts of the part of the UK where you live.
